The case has been filed by a secretary against the govt and Punjab and High court has put a stay on recovery of commutation pension as petitioner wants that the commutation pension be aligned with current interest rate regime as presently it is being recovered at 12% interest rate. We fully support the initiative as pensioners are being given a bad deal in form of commutation which is being recovered at a higher interest rate. We must understand that pension is not a favour but is earned by the individual during his service as he is giving prime years of his life.
Kindly read the interim order below to get a correct perspective and we should not be happy so early as govt counsel is yet to reply.
There has been a lot of buzz about an order by Hon'ble Punjab and Haryana high court about the reduction of commutation of pension period from 15 yrs to 10 yrs and 8 momths.
I have read this order. Kindly be patient as this is only an interim order by the Hon'ble court.
Pl note that this order of 09 Feb 2024 on wp no 2490 and 8222 of 2024, by Punjab and Haryana High court only stays future recovery of the Petitioners.
The reply from Govt Counsel is yet to be submitted.
And the final order shall be granted only after the parties have presented their sides and deliberations have been done in the court and final judgement is delivered.
Till then just wait and pray that this actually should be the final judgement.
